THESE TERMS AND CONDITIONS (“TERMS AND CONDITIONS”) STATE IMPORTANT REQUIREMENTS REGARDING YOUR USE OF HSS- HEALDEAL SUPPORT SERVICES’s COMPUTER SUPPORT SERVICE AND YOUR RELATIONSHIP WITH HSS- Healdeal Support Services. YOU SHOULD READ THEM CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION AND INSTRUCTIONS PERTAINING TO YOUR AND OUR RIGHTS AND OBLIGATIONS FOR THE HSS- HEALDEAL SUPPORT SERVICES SERVICE.

“AGREEMENT” TO THESE TERMS AND CONDITIONS, TOGETHER WITH EACH ACCEPTED ORDER or PLAN ORDER SUBMITTED BY YOU, THE ACCEPTABLE USE POLICY (“AUP”) AND THE PRIVACY POLICY, STATE THE ENTIRE AGREEMENT BETWEEN YOU AND HSS- Healdeal Support Services (THE “AGREEMENT”). You must agree to the Terms and Conditions in order to obtain our Services.

 

SUBMISSION ORDERS

You may order our services through our web site or via telephone with the help of our representative or technician. Once HSS- Healdeal Support Services accepts the Order or Plan Order submitted by you, then you will receive an email from our at the email address that you provide or have provided to us as part of the Registration Process for the Services. HSS- Healdeal Support Services is not responsible for rendering Services in connection with any Order or Plan Order that it has not accepted. Upon acceptance by HSS- Healdeal Support Services of a Plan Order, you will have a Service Plan.

 

PAYMENT

Once you have made payments for services according to the requirements of the corresponding Order or Plan Order, services will be available. HSS- Healdeal Support Services has no obligation to render the services under any Service Plan if the payments as required under any Order or Plan Order have not been made.

 

REFUND POLICY

HSS- Healdeal Support Services’s services are delivered on an integrated delivery platform, which allows us to support your computer(s) remotely. The services we provide may not be successful because the problem you are experiencing may be beyond our ability to resolve remotely or and/or may be due to an irreparable software and/or hardware issue. If for any reason you are not wholly satisfied with our services, we will make commercially reasonable efforts to resolve the issue to you satisfaction

If you are still not satisfied with the service, we offer a money back policy as follows: 1) for our subscription-based plan the Money-Back Guarantee is valid for 90 days, beginning at the time of purchase. 2) For our incidental / “One Time Fix” Orders, the Money-Back Guarantee is valid for 90 days, beginning at the time of 1st Incident.

 

THIRD PARTY AGREEMENTS

As part of the Services, HSS- Healdeal Support Services may suggest certain third party services to you. If you choose to subscribe to or otherwise use any third party services, your use of any such services is subject to the terms of service of such third party service provider. You agree to comply with such provider’s terms of service and that the third party provider is solely responsible for delivery of its services to you and your use of them. Third party services include, but are not limited to technical support, portal, training, music, gaming and storage services that our may elect to make available from time to time. Violation of such third party provider’s terms of service may, in HSS- Healdeal Support Services sole discretion, result in the termination of your customer account and use of service.

 

LIMITED SERVICE WARRANTY

HSS- Healdeal Support Services DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED AS TO THE SERVICES, THE MATERIALS AND THE SOFTWARE WHETHER IN THE NATURE OF MERTCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE. IN THE EVENT THAT YOU ARE NOT SATISFIED WITH HSS- Healdeal Support Services THE SERVICES, YOUR SOLE REMEDY IS TO (A) ALLOW HSS- HEALDEAL SUPPORT SERVICES TO REPERFORM THE SERVICES SUBJECT TO DISPUTE, (B) RE-DOWNLOAD AND REINSTALL THE SOFTWARE.

HSS- Healdeal Support Services SERVICE PLANS COME WITH A 7- DAY, 30- DAY, 60- DAY OR 90-DAY AND 1-YEAR LIMITED SERVICE WARRANTY AS PROVIDED IN ONLINE DOCUMENTATION.

HSS- Healdeal Support Services AND/OR ITS RESPECTIVE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION CONTAINED IN THE SERVICES, MATERIALS OR THE SOFTWARE FOR ANY PURPOSE WHATSOEVER. ALL MATERIALS AND SOFTWARE ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND WHATSOEVER. HSS- Healdeal Support Services AND/OR ITS RESPECTIVE SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

THE MATERIALS COULD INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. HSS- Healdeal Support Services AND/OR ITS RESPECTIVE SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE MATERIALS AND/OR THE SOFTWARE DESCRIBED HEREIN AT ANY TIME. IN NO EVENT SHALL HSS- Healdeal Support Services AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SERVICES, MATERIALS OR SOFTWARE, FAILURE TO PROVIDE THE SAME, OR INFORMATION AVAILABLE IN THE MATERIALS.

 

LIMITATION OF LIABILITY

Notwithstanding anything to the contrary, in no event shall HSS- Healdeal Support Services be liable to you in excess of the amounts actually paid by you to HSS- Healdeal Support Services under the Plan Order that is the subject of the dispute.

 

LIMITATIONS ON ACTIONS

Any cause of action by you must be commenced within one year after the cause of action arose or it shall be forever waived and barred.

 

TERM AND TERMINATION

HSS- Healdeal Support Services at its sole election may terminate or suspend your Service immediately without notice if, in the sole discretion of HSS- Healdeal Support Services:

(a) you are in breach of any of the Terms and Conditions (including but not limited to all policies regarding abuse and acceptable use of the Service) or any license for Third Party Software;
(b) your use of the Service is prohibited by law or is disruptive to, adversely impacts or causes a malfunction to the Service, HSS- Healdeal Support Services’s network, or the use and enjoyment of HSS- Healdeal Support Services’s other users;
(c) HSS- Healdeal Support Services receives an order from a court to terminate the Service you are using;
(d) if HSS- Healdeal Support Services for any reason ceases to offer the Service;
(e) if you are no longer a HSS- Healdeal Support Services customer, or
(f) HSS- Healdeal Support Services determines that you are abusing the Service.

HSS- Healdeal Support Services, in its sole discretion, may refuse to accept your request for the Service, renewal or re-subscription following a termination or suspension of your use of the Service.

 

LAW FORUM

This Agreement and the rights and obligations of the parties under this Agreement and any disputes arising out of or in connection with this Agreement shall be governed in all respects by the laws of the state of Georgia without regard to conflicts of law principles that would require the application of the laws of any other jurisdiction on.

 

CUSTOMER’S REPRESENTATIONS AND WARRANTIES

YOU ARE IN NEED OF THE SERVICES REQUESTED AND YOU ARE NOT A COMPETITOR OF HSS- HEALDEAL SUPPORT SERVICES POSING AS A CUSTOMER FOR THE PURPOSE OF OBSERVING HSS- HEALDEAL SUPPORT SERVICES’s PROPRIETARY SERVICES; YOU ARE THE OWNER OF AND RESPONSIBLE FOR THE COMPUTER AT ISSUE AND YOU HAVE THE AUTHORITY TO REQUEST HSS- HEALDEAL SUPPORT SERVICES SERVICES; YOU WILL NOT ATTEMPT TO UPLOAD MALWARE OR MALICIOUS CODE TO HSS- HEALDEAL SUPPORT SERVICES’s SYSTEM OR COMPUTERS; AND YOU HAVE NOT ACCESSED AND THERE IS NO CHILD PORNOGRAPHY STORED ON THIS COMPUTER, AND YOU UNDERSTAND THAT IF THIS REPRESENTATION IS FALSE, YOU HAVE NO EXPECTATION OF PRIVACY REGARDING SUCH ILLEGAL ACTIVITIES OR MATERIALS.

Privacy Policy

This privacy policy discloses the practices for HSS- Healdeal Support Services to protect privacy for users of its Service. The “service” is defined for user support service owned and operated by HSS- Healdeal Support Services. Submitting your information on our website constitutes acceptance of this Privacy Policy.

Information collection and use

We collect the information through the website/E-mail/phone. We collect the information from the users at several different points.

Personal information

In order to use our services you need to complete registration form. Our registration form includes information such as First and last name, E-mail address, Postal address, Personal identifier etc. We collect your personal information so that we can contact you regarding the product and/or services you have requested. Apart from that we will let you know about our special offers, re-registration/renewal notifications, surveys on improving our service time-to-time.

Payment information

If the user is registered to use our services, we will collect credit card information and other payment information necessary for payments. HSS- Healdeal Support Services may use a third party to process and verify credit cards for billing purposes. This requires us to share user name, credit card number, expiration date and billing address with the credit card processing company. When processing a payment transaction, HSS- Healdeal Support Services will also obtain information regarding the amount of the payment and other transaction data. We may transfer or disclose this payment information to a third party only to the extent necessary in order to complete the payment processing.

Computer System information

(i) Subscriber information

This information is related to your computer. This information includes about the date of purchase of your computer, type of computer, the identification number of your computer, make and model of your computer and/or any computer hardware, software or peripherals attached to it, the condition of the computer, system and registry data about software installations and hardware configurations, and error tracking files. This information helps us to enhance our supported product list and update our support tools.

(ii) Remote access

While requesting support you may request for the problem to be resolved by taking control of your computer. HSS- Healdeal Support Services uses qualified tools to diagnose correct problems remotely over an internet from the user’s computer. Only well trained experts use remote access software. In addition, Experts will not use Remote Access tools to obtain confidential or sensitive information stored on user computer or network, or cause user to experience system problems.

(iii.) Diagnostic tools

HSS- Healdeal Support Services online diagnostic tools application uses some useful information related to the state of computer system and applications on it. This information is packaged into a document containing all the essential details needed by HSS- Healdeal Support Services and is sent securely over the Internet to the HSS- Healdeal Support Services server or a third party server appointed by us. We analyze all the information to diagnose and correct the problems. Use of the Remote Access and Diagnoses applications is also subject to the terms of use in the respective software license agreements.

Cookies

We use “cookies” to help create a more effective and convenient site experience. So Cookie is available on our Website. The main purpose of cookies is to identify users and prepare customized web pages for them. Usage of cookie is not related to any personal information of users so it will not harm the security of users.

Log Files

We use IP addresses to analyze trends, administer the site, track user movement, and gather broad demographic information for aggregate use.

Live Help session records

HSS- Healdeal Support Services provides on-line and off-line sessions between user and a Technical support Executive for providing a quality of service to users. We may record this on-line and off-line session to improve the Service, build a support knowledge base, and/or conduct internal market research.

Sharing

We will share aggregated demographic information with our partners and advertisers. This information is not related to any personal information unless specifically required to allow use of specific widgets within the toolbar.

Refund Policy

HSS- Healdeal Support Services take utmost care about the support and services purchased by our clients through the purchase form both online and offline. We always make efforts to give 100% satisfaction of our clients related to the HSS- Healdeal Support Services services. You will be eligible for a full refund within the first 90 days of your payment, if HSS- Healdeal Support Services has not been able to resolve even a single issue brought up by you within the first 90 days of the subscription. Therefore, it is agreed by the parties that if there are one or more resolved issues, the fees for the Subscription Service will not be refundable. Now with standing this, HSS- Healdeal Support Services may, at its sole discretion and on a case by case basis, agree to a refund of Subscription fees after deducting relevant charges for servicing the Customer. Such relevant charges will be decided solely by HSS- Healdeal Support Services depending on the services performed in the specific case.

The eligibility criteria for refund of amount
» Full refund: if any issue is not fixed within 90 days (for incident based plan only).
» Subscription based plan: you can ask for full refund if none of the issues are fixed within 90 days after registration.
» If one or more issues are fixed and customer still wants refund of his/her amount before time period mentioned in the agreement then partial refund will be done, after subtracting the service charge on fixed issues.
» Cases which are fixed on our part and something goes wrong on your computer due to hardware issues, however services will be continued on the existing computer or can be exchanged to a new computer.
» Refund if the issues are fixed and 90 days of subscription has completed, only partial refund will be given for rest of the period that remains.

Limitation of Liability

INDEPENDENT SERVICE PROVIDER:
HSS- Healdeal Support Services is an independent remote tech support services for several third-party software, hardware and peripherals. Our company has no affiliation with any of these third party companies unless such relationship is expressly specified.

WARRANTY COVERAGE:
If your product (software, hardware, and peripherals) is under warranty, the repair service maybe available free at respective third party. HSS- Healdeal Support Services recommends that you may contact the relevant third party.

CUSTOMER TESTIMONIALS:
Testimonials found on our site is just the client’s experience shared by clients through e-mail and social networks. They may not represent or guarantee that anyone will experience the same or similar results.

REMOTE ACCESS TO COMPUTER:
We recommend that you review the section (1.c.ii) of privacy policy for remote access policy.

THIRD-PARTY DIAGNOSTIC SOFTWARE:
HSS- Healdeal Support Services when necessary use third-party software for diagnosing and fixing the problem. The software tools used are from leading companies such as Microsoft (e.g. Microsoft Security Essentials) or AVG (AVG Tune up) etc. Some of these third-party tools are available for free that you can obtain directly from these sites. HSS- Healdeal Support Services does not charge for this software.

PROPRIETARY SOFTWARE:
HSS- Healdeal Support Services currently does not use or sell any proprietary computer repair software or diagnostic tools.

CUSTOMER SATISFACTION:
Customer satisfaction has a prime importance. Our technicians are always there to diagnose your computer issues and handle your queries till you satisfy.

NO AUTOMATIC RENEWALS:
Currently it is our policy to not automatically renew our subscribers.
